I remember in college hearing a pastor named Bill Johnson say, "I can't afford to have a thought in my head about me that God does not have." He went on to describe a binder that he had put together over the years of scripture references, testimonies of God's faithfulness, and prophetic words of encouragement that he had received.After hearing that, when I would read through scripture, I would recognize stories when God would have the Israelites name a specific location for what He had done there, or build a pile of stones as a remembrance of God's faithfulness to their ancestors. These places, these stones, these physical reminders of God's faithfulness, were meant to be experienced and to remind us of God and His works.From them on, I had the desire to make tools for those of us in the modern world to practice the same "remembering" of God's nature and his works in our lives and in the lives of the people of God at large, and from that, Zakar AI was born.I am follower of Jesus, a husband, father, son, entrepreneur, and I am excited to go on a journey with you of stewarding what God has said and done so that we can live forward from that wonderful foundation and wellspring of life.

Terms of Service for Zakar AI

1. Introduction

Welcome to Zakar AI ("App") operated by Zakar AI LLC ("us", "we", or "our"). These Terms of Service ("Terms") govern your use of our App available on the App Store and Google Play, and any related services provided by us.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.



2. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding your password and for any activities or actions under your account, whether with our App or a third-party service.



3. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Zakar AI LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Zakar AI LLC.



4. Links to Other Websites

Our App may contain links to third-party websites or services not owned or controlled by Zakar AI LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Zakar AI LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by use of or reliance on any such content, goods, or services.



5. Electronic Communications & Marketing Emails

We may send you transactional electronic communications related to your use of the App (e.g., account notices, password resets, purchase receipts, security alerts). These messages are necessary for providing the App.

We send marketing emails (e.g., product news, feature updates) only with your consent. During account creation, we present an optional, unchecked control for marketing emails. You can withdraw consent at any time by switching Marketing Emails to Off in Profile → Settings, or by clicking Unsubscribe in any marketing email. Unsubscribing from marketing emails does not affect transactional messages. We may use third-party providers (including Resend and OneSignal) to deliver and analyze email communications, as described in our Privacy Policy.



6. Third-Party Analytics & AI Processing

We use third-party analytics providers (including Firebase Analytics, Firebase Crashlytics, and Mixpanel) to collect and process pseudonymous usage data (e.g., device identifiers, events, crash reports, and performance diagnostics) to operate, secure, and improve the App. Analytics usage is described in our Privacy Policy.

The App also allows you to record audio and enter text which may be processed by Google's Vertex AI (Gemini) to generate transcriptions, summaries, key points, and declarations. Your recorded content is stored securely in your account and is used solely to provide App features to you. We do not use your personal recordings to train AI models. AI processing is described further in our Privacy Policy.



7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.



8. Limitation of Liability

In no event shall Zakar AI LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, goodwill, or other intangible losses — resulting from (i) your access to or inability to access the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; or (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort, or any other legal theory.



9. Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.



10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law provisions. You agree to the exclusive jurisdiction of the state and federal courts located in Georgia for any disputes arising out of or relating to these Terms or the App.



11. Changes

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice before new terms take effect.

1. Introduction

Zakar AI LLC ("we," "us," or "our") operates the Zakar AI mobile application ("App"). This Privacy Policy informs you of our policies regarding the collection, use, and disclosure of personal information when you use our App and the choices you have associated with that data.



2. Information Collection and Use

We collect several types of information to provide and improve our App.



Personal Data

While using our App, we may ask you to provide certain personally identifiable information ("Personal Data"), including:

Usage Data

When you access the App on a mobile device, we may collect certain information automatically, including the type of mobile device you use, your device's unique ID, the IP address of your device, your mobile operating system, the type of mobile browser you use, and other diagnostic data.



Audio & Text Content

The App allows you to record audio and enter text to capture prophetic words and spiritual inspiration. This content is stored securely in your account and processed by Google's Vertex AI (Gemini) to generate transcriptions, summaries, key points, and declarations. Your recorded content is used solely to provide App features to you. We do not use your personal recordings to train AI models.



3. Tracking & Cookies Data

We use cookies and similar tracking technologies to track activity on our App and store certain information. You can instruct your device to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our App.



4. Use of Data

Zakar AI LLC uses the collected data to:

Provide and maintain our App

Notify you about changes to our App

Allow you to participate in interactive features of our App

Provide customer support

Gather analysis to improve our App

Monitor usage of our App

Detect, prevent, and address technical issues



5. Email Communications & Marketing

We send two types of email: (a) transactional emails necessary to provide the App (e.g., account notices, password resets, purchase receipts, security alerts), and (b) marketing emails (e.g., product news, feature updates, community announcements) sent only with your consent.

When you consent to marketing emails, we record that preference in our systems, including a timestamp, source (e.g., "signupcheckbox" or "settingstoggle"), and a consent version referencing the wording presented in-App at the time. Every marketing email includes a visible Unsubscribe link and our physical mailing address. You may withdraw consent at any time by using the Unsubscribe link or by switching Marketing Emails to Off in Profile → Settings. Withdrawing consent does not affect transactional emails.

Where applicable (e.g., EEA/UK), our legal basis for marketing emails is your consent. Our legal basis for transactional emails is performance of a contract and/or legitimate interests.

We use third-party providers, including Resend (transactional email) and OneSignal (marketing email), to deliver and analyze email communications. To provide these services, we may share your email address and limited engagement data (e.g., delivery status, opens, clicks, unsubscribe events) with such providers. These providers are contractually restricted to using your data only to perform services for us.



Data Retention (Email Preferences)

We retain records of your marketing email preferences (including consent and unsubscribe events) for as long as you maintain an account or as reasonably necessary for compliance, dispute resolution, and auditing. We retain engagement metadata (e.g., opens, clicks, unsubscribes) for operational and analytics purposes consistent with this Policy.



6. Analytics, Diagnostics & AI Processing

We use analytics and diagnostics services to operate, secure, and improve the App, including Firebase Analytics, Firebase Crashlytics, and Mixpanel. These tools collect pseudonymous usage information such as device and application identifiers, app version, screens viewed, events and button taps, session duration, crash reports, performance diagnostics, and coarse region. We use this information in aggregated or pseudonymous form to analyze usage trends, diagnose problems, and guide product development.



Tracking Technologies (SDKs)

Our App uses software development kits (SDKs) from our analytics providers (Google/Firebase, Mixpanel) to enable event collection, performance monitoring, and crash reporting.



Your Choices (Analytics)

The App does not currently provide an in-App control to disable analytics collection. You may be able to limit certain identifiers through your device settings (e.g., reset platform analytics/advertising identifiers). You can also contact us at [email protected] to request that we stop associating future analytics with your account or device to the extent feasible. Some essential diagnostics necessary to operate and secure the App may continue.



Data Retention (Analytics)

We retain analytics data only as long as necessary for the purposes described in this Policy. Aggregated data that does not identify you may be retained longer.



7. Transfer of Data

Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction where data protection laws may differ. If you are located outside the United States and choose to provide information to us, please note that we transfer and process that data in the United States.



8. Disclosure of Data

We may disclose your Personal Data in the good faith belief that such action is necessary to:

Comply with a legal obligation

Protect and defend the rights or property of Zakar AI LLC

Prevent or investigate possible wrongdoing in connection with the App

Protect the personal safety of users of the App or the public

Protect against legal liability



9. Service Providers

We may employ third-party companies and individuals to facilitate our App, provide the App on our behalf, or assist us in analyzing how our App is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. Current service providers include:

Firebase (Google) — Authentication, database, storage, analytics, crash reporting, and AI processing

Mixpanel — Product analytics

Resend — Transactional email delivery

OneSignal — Marketing email delivery

RevenueCat — Subscription and in-app purchase management



10. Links to Other Sites

Our App may contain links to other sites not operated by us. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.



11. Changes to This Policy

We reserve the right to update this Privacy Policy at any time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the Last Updated date below. You are advised to review this Policy periodically for any changes.
